This is a permission-required license: unlike a standard open-source
license, using, copying, modifying, merging, publishing, distributing,
or sub-licensing this Software or any derivative work built on it
requires the express, prior permission of Aaron (aaron@aaronworld.uk),
the owner of this project ("Arkchemy", formerly "Bramble", or whatever
name it operates under at any given time), in addition to the
conditions below. Simply finding this repository public does not
grant permission to do any of the above.
1. PERMISSION REQUIRED
No use, copying, modification, merging, publication, distribution,
or sub-licensing of the Software, in source or binary form, or of
any derivative/fork/port of it, is authorized without Aaron's prior,
express permission. Contact aaron@aaronworld.uk to request it.
2. PROMINENT ATTRIBUTION
Where permission is granted, all copies, forks, ports, or derivative
works -- whether distributed in source or binary form -- must
prominently credit "Arkchemy" (or whatever name this project
operates under at the time) as the original project, and must
individually credit every contributor listed in this repository's
own CONTRIBUTORS.csv (root of the repository) alongside their
stated role. This credit must be clearly visible in the
repository's readme, the tool's "About"/"Credits" screen, or an
equivalent, easily accessible user-visible location.
3. ABSOLUTE PROHIBITION OF SALES
Neither the Software nor any fork, port, or derivative work built
upon it may be sold, commercialized, placed behind a paywall, or
distributed via any mechanism that requires payment, paid
subscriptions, or ads-for-access. Access to the software and its
features must remain 100% free of charge. This applies equally to
any online service (e.g. "Skylanders Online" or any other
Arkchemy-operated mode/service) built on this Software: no feature
may ever be paywalled or made sponsor-exclusive.
4. VOLUNTARY SUPPORT EXCEPTION
Notwithstanding Section 3, voluntary donation methods (a QR code in
an in-app/in-service lobby, GitHub Sponsors, Ko-fi/Patreon links, or
similar "support the project" mechanisms) are explicitly permitted
and confer no gameplay or feature advantage of any kind.
5. SHARE-ALIKE & SOURCE AVAILABILITY (where permission is granted)
Any fork, port, or derivative work this license's permission is
granted for must itself be distributed under this exact same
license and must not be re-licensed. Any publicly distributed
binary or compiled form of the Software or its derivatives must be
accompanied by a publicly accessible link to its complete, unedited
source code.
6. NO REDISTRIBUTION OF GENERATED GAME OUTPUT
This Software is a static recompilation tool: it transforms a
user's own, legally-obtained copy of copyrighted game software into
a form that runs on different hardware. The Software itself
contains no assets, code, or other content taken from any such
game, and no project operated under this license hosts or
distributes any such copyrighted game content -- it is injected
locally by each user from their own legal copy. Any `.nro`, ROM,
asset archive, or other output produced by running this Software
against a copyrighted game is NOT covered by this license and is
NOT authorized for redistribution -- doing so is copyright
infringement, independent of and in addition to whatever
restrictions the original game's copyright holder imposes, and
independent of and in addition to whatever separate terms the
relevant game publisher (e.g. Activision, for the Skylanders
series) imposes on its own software, which every user remains
separately responsible for complying with. This Software is
provided solely for personal, educational, and interoperability
purposes against games the user already legitimately owns.
7. TICOHQ -- CONDITIONAL, NOT ABSOLUTE, EXCLUSION
The tico project (ticoverse.com), ticohq, and their members are not
granted permission to use, integrate, fork, or build upon this
Software or any derivative work of it, UNLESS ticohq's own
corresponding code is itself made available for others to use, with
credit, under terms ticohq grants with Aaron's/Arkchemy's permission
-- i.e. reciprocal openness is required before this exclusion is
lifted for ticohq specifically. This exclusion does not apply to
this project's own use of separately-licensed third-party emulation
cores or libraries, which remain governed by their own real,
independent licenses regardless of this section.
8. THIRD-PARTY LICENSES
Where this Software depends on separately-licensed third-party
components (e.g. emulation cores, libraries), those components
remain governed by their own real, independent licenses, which this
license does not override or supersede.
9. LICENSE MAY CHANGE
This license may be revised in the future at Aaron's/Arkchemy's
discretion. Continued use of the Software, or of any Arkchemy
project/service/mode (including fully offline modes), requires
agreement to whichever version of this license is current at the
time of use.
10. LICENSE PRESERVATION
This complete license text must be included in all copies,
substantial portions, or derivative works of the Software that
permission has been granted for.
11. CONFIDENTIAL PROJECT PLANNING MATERIAL
This project's internal planning documentation (currently hosted on
Notion) is confidential and is NOT covered by the permissions in
this license: no part of it may be copied, quoted, redistributed,
or shared outside of individuals granted direct access by Aaron,
regardless of how that access was granted (development team
membership, or a research-access invite extended to journalists or
Skylanders content creators/researchers). Read access does not
imply any right to republish or redistribute its contents. This
confidentiality obligation survives any change to this license
under Section 9 and applies independently of it.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS
OR IMPLIED. IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY CLAIM,
DAMAGES, OR OTHER LIABILITY ARISING FROM USE OF THE SOFTWARE.
